Illegal Upload of New Super Mario Bros Results in $1.5m Fine

James Burt with an unidentified companion. Was caught uploading the New Super Mario Brothers game online for users to download. Super Mario Bros Wii, which was due for official release on November 12, 2009, was copied and offered by Burt online from November 6. Upon upload thousands of users had already downloaded the game. Once Nintendo was alerted they hired investigators which led the path straight to James Burt's location.

Once prosecuted a $1.5 million dollar fine was issued. This is supposedly the amount that was loss since the game was pirated.

What we say is that either way games are going to be pirated. Whether or not its James, someone else will upload the game in due time. Pirates will download regardless, so the equivalent loss of 1.5 million seems a bit ridiculous.

But why is that James was caught and the millions of pirate games out there, no one has really been prosecuted? We did a little investigating and the great people at Reddit.com was able to find the reason.
